In connection with the implementation of the obligations set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the GDPR), we hereby inform our esteemed Clients as follows:
The processing of personal data in connection with notarial proceedings is in every case based on a provision of European Union law, an act of Parliament, a government decree, or other legislation. As controller, the notary processes personal data for the performance of a task carried out in the exercise of official authority vested in the notary by law, or for compliance with a legal obligation. Where the provision of personal data is based on a statutory obligation and the data subject fails to comply with it, this may – having regard to the provisions of the applicable procedural legislation – result in the refusal of the application. The notice on the processing of personal data carried out in connection with proceedings falling within the competence of notaries can be viewed by clicking here.
We inform our esteemed Clients that if draft deeds, copies, images, or other documents containing personal data are received at the notarial office's email address, the notary shall – in the absence of a written statement to the contrary – treat them as data submitted for the performance of a task carried out in the exercise of the notary's official authority, or for compliance with a legal obligation, and as attachments to documents and applications relating to the notary's proceedings.
