Notarial Fees

Notarial Fees

New rules on notarial fees entered into force on 1 July 2019. Decree No. 22/2018 (VIII. 23.) of the Minister of Justice replaced the 1991 decree, which had been in force for more than two decades.

Notarial remuneration is therefore not a matter of negotiation, but is made up of items determined by law. A notary's fee is not the same as a duty, and therefore the 1990 Act on Duties does not apply to it.

The Four Components of the Notarial Fee

  • Professional Fee
  • Flat-Rate Expense Allowance (40% of the professional fee)
  • Fee for Certified Copies or Extracts
  • Out-of-Pocket Expenses

The Professional Fee May Be Calculated in Two Ways

  • Based on the value of the transaction (e.g. sale of real property, lease agreement)
  • Based on the time spent on the proceedings, if the value cannot be determined
